Court orders FIR against Banking Associate of JKB for account disclosure

SRINAGAR, NOV 16: Taking strong exemption to an alleged breach of trust, a court here on Thursday ordered the registration of an FIR against a Banking Associate of Jammu and Kashmir Bank for allegedly disclosing account details of a renowned radiologist.

Mr. Feroz Ahmad Khan, Forest Magistrate Srinagar, passed the orders on a complaint filed by Dr Jehangir Ahmad Bhat, the radiologist against one D H Dar, working as a Banking Associate with the JKB.  The radiologist had alleged that the Banking Associate with “malafide intention” leaked all the information pertaining to his salary account with a particular Branch.  By doing it, the Banking Associate, he alleged has “committed a breach of trust.”

He said that the Banking Associate under the mandate of his duty was supposed to maintain the secrecy as against divulging his account information. Further Bhat alleged that he has got a lot of spam communications over the last several months which he suspects was due to the actions of the Banking Associate.

Subsequent to the filing of the complaint, police had directed the Station House Officer concerned to file a report.

“I have heard Counsel for the applicant, perused the augments made in the complaint….a cumulative reading of averments of police report draws only one conclusion that there has been commission of cognizable offence and as such police station concerned was to register an FIR under the relevant provisions of law,” the court said, adding, “In the ….police report it has been mentioned by the police that they have received a communication from the bank wherein the bank has acknowledged and admitted that a disciplinary authority has been constituted against the employee…”

Ultimately, the court observed that it deemed it proper to direct SHO police station Parimpora to register an FIR against the accused (Banking Associate) for the commission of offences under relevant provisions of law. It also directed the SHO to furnish the compliance report in clear and in terms as to whether FIR is registered or not by August 18.
