SRINAGAR, AUG 31: The High Court of J&K and Ladakh on Thursday upheld Principal Sessions Judge Kargil’s verdict, sentencing a man for the murder of his 3-year-old stepdaughter in 2010.
According to the prosecution, on 22 September 2010 at 12 pm, a complaint was received in police station Kargil by a woman levelling allegations against Dass of beating her children as he being her 2nd husband and that girl’s body was found in the septic tank.
The convicted person, Bhagwat Dass had filed an appeal against the judgment of conviction dated 21 November 2013 and sentence order dated 26 November 2013 for the commission of offence punishable under section 302 RPC in 2010.
Dass had been held guilty, convicted and sentenced to life imprisonment and a fine of Rs 5000 for the murder of one small baby girl of 3 years of age. The trial judge had made a reference to the High Court on 26 November 2013 for confirmation of the sentence.
“After churning the entire prosecution evidence by us being the first court of appeal, we are of the firm view that the prosecution has been able to prove the charges against the appellant (Dass) punishable under section 302 RPC beyond a reasonable doubt,” a division bench of Justices Vinod Chatterji Koul and Mohan Lal said, adding, “therefore, the conviction of appellant for the charge deserves to be upheld.” Resultantly, the court said that the appeal stands dismissed, while the conviction and sentence rendered by the trial court against the appellant for commission of an offence under section 302 RPC stands confirmed and upheld.
