New provision under Sec 144 CrPC to regulate sensitive content on social media: DGP

ADGP urges vigilance, pre-emptive measures to safeguard society from disruptive elements
SRINAGAR, NOV 30: Jammu and Kashmir’s Director General of Police, R R Swain Thursday said that sharing any content on social media promoting disharmony would be considered a criminal offence in the region.
A new provision under Section 144 of the Code of Criminal Procedure (CrPC) will be implemented to address this issue, according to Swain.
The law will specifically target the posting of inflammatory messages or videos by individuals identified as “terrorists, separatists, or anti-national elements.”
In a hastily-called press conference in Jammu, DGP Swain revealed the police’s intention to introduce a new law aimed at preventing the dissemination of sensitive content on social media.
Addressing the NIT Srinagar row, Swain said that swift action has been taken against the individual responsible for the offensive remarks, with a filed FIR.
Swain further emphasized that the forthcoming law, operating under Section 144 CrPC, aims to regulate the posting of any content, including messages, videos, or audio, that has the potential to incite communal disharmony and threaten or terrorize individuals. He clarified that both the originators of such content and those forwarding or sharing it would be held accountable under the law.
Before the law is officially enacted, Swain mentioned that it will undergo a period of public consultation to gather feedback. He urged the public to report any such content to the nearest police station.
The DGP highlighted the legal consequences for posting content that aims to harm the respect of the Prophet Muhammad, stating that individuals engaging in such actions would be indexed and face disadvantages as a result.
Swain also underscored the disruptive impact of such content, citing instances where it has led to the closure of educational institutions. He expressed concerns about the role of Pakistani social media handles in generating and disseminating content that local elements share to create trouble and disrupt peace.
The police chief assured that the police would collaborate with the people of Kashmir to isolate and address such miscreants.
DGP Swain urged students to focus on their studies and avoid engaging in violent activities. He issued a warning to those attempting to exploit situations to disturb peace in Jammu and Kashmir, calling for vigilance from both the police and the general public.
Regarding social media use, Swain cautioned against spreading misinformation.
Meanwhile, ADGP Vijay Kumar conducted a comprehensive review of the law and order situation in Jammu and Kashmir.
According to the officials, while chairing a meeting with police, CAPF, and intelligence units in PCR Kashmir, Kumar commended timely actions taken by law enforcement while urging officers to maintain control, prevent the exploitation of situations, and identify and address miscreants spreading rumours.
Kumar emphasized the importance of preserving the sanctity of law and called on intelligence agencies to maintain a vigilant watch on the evolving situation.
