J&K breaks barriers: Embraces diversity with ‘Third Gender’ inclusion in recruitment forms

SRINAGAR, OCT 11: In a significant development, the Jammu and Kashmir government has taken a progressive step towards the inclusion and protection of transgender persons in the Union Territory by ordering the incorporation of a ‘Third Gender/Any Other Category’ option in application forms for various recruitment posts.

This move aligns with the Transgender Persons (Protection of Rights) Act of 2019, which mandates the prevention of discrimination and the promotion of transgender rights in educational institutions, employment opportunities, healthcare services, and public services.

An order issued by the Jammu and Kashmir’s General Administration Department states that the Transgender Persons (Protection of Rights) Act of 2019, a pivotal piece of legislation, serves to eradicate discrimination, denial, and unfair treatment directed towards members of the transgender community in India. It obliges the government to take necessary measures to facilitate the full and effective participation of transgender individuals in society, ensure their access to welfare schemes framed by the government, and prevent discrimination in matters related to employment.

In pursuance of the provisions of this significant legislation, the Department of Personnel and Training (DOPT), a division of the Ministry of Personnel, Public Grievances, and Pensions, Government of India, issued an Office Memorandum No. 39028/02/2016-Estt (B) on April 20, 2020.

This memorandum addressed all ministries and departments of the Government of India, requesting them to modify relevant examination rules to include ‘Transgender’ as a separate category of gender. Subsequently, DOPT also notified the Civil Services Examination Rules, 2020 on February 5, 2020, which explicitly provided for the inclusion of ‘Transgender’ as a distinct gender category for the civil services examination.

In compliance with these directives, the Jammu and Kashmir government has now instructed all administrative departments to amend relevant examination and service rules to incorporate a separate category labelled as ‘Third Gender/Any Other Category’ in the application forms for recruitment to various posts within the Union Territory. This action is aimed at ensuring that the relevant rules adhere to the Transgender Persons (Protection of Rights) Act of 2019 and serve to protect the rights and dignity of transgender individuals within the region. This momentous decision by the Jammu and Kashmir government represents a significant stride toward social inclusivity and the protection of the rights of transgender persons in the Union Territory.

It demonstrates a commitment to the principles of equality, non-discrimination, and social justice, as enshrined in the Transgender Persons (Protection of Rights) Act of 2019. As a result, transgender individuals in Jammu and Kashmir will now have improved access to employment opportunities, education, healthcare, and public services without fear of discrimination, marking a positive and progressive step towards a more inclusive and equitable society.
