J&K’s Power Play Unchanged: New Rules Clarify, Not Alter, UT’s Governance

Srinagar, July 13:  In a move aimed at streamlining administration, the Ministry of Home Affairs has issued new guidelines clarifying its transaction of business rules. The notification, dated July 13, 2024, has sparked discussions across the region, with some media outlets mistakenly reporting it as an amendment to the Jammu and Kashmir Reorganization Act of 2019.

Official sources have been quick to dispel these misconceptions, emphasizing that the recent changes are merely clarifications to existing rules, not alterations to the fundamental Act. “This is about reducing ambiguity, not shifting power,” stated a senior government official who wished to remain anonymous.

The Jammu and Kashmir Reorganization Act, passed by the Indian Parliament in August 2019 and upheld by the Supreme Court, remains unchanged. Key provisions of the Act continue to define the powers of the Legislative Assembly and the Lieutenant Governor. The Assembly retains its authority to legislate on State List matters, barring “Police” and “Public Order,” while the Lieutenant Governor’s discretionary powers remain intact in specified areas.

These clarifications build upon the Transaction of Business Rules issued by the President in 2020, which were designed to facilitate smoother governmental operations. The latest notification aims to provide “better clarity on the processes,” as per the officials, to enable more efficient administration of the Union Territory. As Jammu and Kashmir continues its journey under its current administrative structure, these new guidelines are seen as fine-tuning the machinery of governance rather than overhauling it.

While the changes may seem technical, their impact on the day-to-day functioning of the UT’s administration could be significant, potentially leading to swifter decision-making and implementation of policies.  As one local analyst put it, “It’s like oiling the gears of a complex machine – small changes can make a big difference in how smoothly it runs.”

As the dust settles on these new clarifications, all eyes will be on how they translate into tangible improvements in the governance of Jammu and Kashmir.
