The Supreme Court Bar Association strongly condemns the reported threats, intimidation, harassment and acts of violence directed against Hon’ble Mr. Justice Gautam Patel (Retd.) and members of his family in connection with a judicial decision rendered by His Lordship. The reports of such incidents, including threats and physical harm allegedly inflicted upon a member of his family, are deeply disturbing and strike at the very foundation of the rule of law.
The Supreme Court Bar Association unequivocally condemns these acts in the strongest possible terms. Any attempt to threaten, intimidate or coerce a Judge, whether serving or retired, or members of the Judge’s family, on account of the discharge of judicial functions, constitutes a direct assault on the independence of the judiciary and the constitutional values that sustain our democratic system.
In a constitutional democracy governed by the rule of law, judicial decisions may be challenged only through lawful remedies available under the legal framework. Disagreement with a judgment can never justify threats, violence, intimidation or attempts to undermine the dignity and authority of the courts.
The independence of the judiciary is one of the basic features of the Constitution of India. Judges must be able to discharge their duties without fear, favour, affection or ill-will. Any act designed to create fear or exert pressure upon a Judge not only affects the individual concerned but also threatens public confidence in the administration of justice.
The Supreme Court Bar Association expresses its full solidarity and support to Hon’ble Mr. Justice Gautam Patel (Retd.) and his family during this difficult time. The Association also reaffirms its unwavering commitment to safeguarding the independence of the judiciary and preserving the sanctity of the judicial process.
The Supreme Court Bar Association calls upon the concerned authorities in India and abroad to conduct a prompt, thorough and effective investigation into the reported incidents and to take all necessary measures to ensure the safety and security of Justice Patel and his family. Those responsible must be identified and proceeded against strictly in accordance with law.
A society that fails to protect its Judges ultimately weakens the protection of the rights and liberties of all its citizens. The Supreme Court Bar Association therefore urges that every necessary step be taken to uphold the dignity of the judiciary and to prevent any form of intimidation directed against members of the judicial fraternity.
