Court Awards 6 Months Imprisonment In Cheque Bounce Case

SRINAGAR, OCT 27: A court in Srinagar convicted and sentenced a man to six month’s simple imprisonment and imposed a fine to the tune of rupees double the cheque amount, Rs.6,52000, in a cheque bounce case.
Judge Small Causes Srinagar Tabasum convicted and sentenced Mohd Maqbool Lone of Tarzoa Sopore, observing essential ingredients of Section 138 of Negotiable Instruments Act stand established by the complainant—Ramesh Kumar Vasandani Through its Authorized Attorney Holder Aat present Chanapora Srinagar.

“Accused has committed offence u/s 138 read with section 142 of Negotiable Instruments Act. Therefore, (the) accused is convicted for commission of offence u/s 138 Negotiable Instruments Act only,” the court said and sentenced him to undergo simple imprisonment for a period of six months.
The court also sentenced him by way of a fine to the tune of rupees double the cheque amount which amount equals to Rs.6,52000.
“The fine imposed shall be recovered by the issuance of levy warrant to be executed by District Collector Baramullah authorizing him to realize the total amounting to Rs. Rs.6,52000 (Six lacs fifty-two thousand) by execution/attachment through civil process against both movable and immovable property of the accused,” the court said and directed District Collector Baramulla to file a compliance report within one month.
According to the plea, the complainant had paid advance money to the accused in connection with apple business. However after a few years, the business ties did not remain the same and finally after the settlement of accounts, an amount of Rs. 3,26000 (Three lac Twenty Six thousand) were found outstanding against the accused. The accused had issued a cheque to the complainant in 2020 which was dishonoured.
